Yes, I know that people have successfully claimed despite 2 year+ gaps. Including the dealer being asked to photocopy the service book, so BMW warranty were definitely aware of the violation of the letter of the law. With that said, I believe that the mileage was very low between services, and all history was BMW main dealer, so the claimant was not taking the p*ss (it was an oversight, not a negligent approach to looking after the car).
