If all you want is the delimit then surely there isnt a problem, as clearly its an official BMW option, and would not void the warranty. Didnt in my case .. which raises the question ...why dont I get the limit removed on the new engine ??? mmmm Remap - another matter.... simple.

Even on the old E34 the dealers were able to tell if the ECU had been tinkered with as the Gorilla correctly states, they just use a countback / checksum approach. Luckily, you could just remove the secondary throttle cable which actually pulled the throttle back
Personally, I wouldn't re-map a CSL for what little gains it yields. And in terms of removing the limiter, is it really that much use? Very little de-restricted stuff in Germany these days and in the UK, your looking at a day in court and the bus home.
